This agreement outlines the terms and conditions of the services provided by SimplyFSBO, Inc. to homeowners who wish to sell their properties without the assistance of a real estate brokerage, as well as to home buyers who wish to purchase properties without the assistance of a real estate brokerage.

By using SimplyFSBO, Inc.’s services, you acknowledge and agree that SimplyFSBO, Inc. is not a real estate brokerage. While its representatives may hold a real estate license, they do not enter into agency and/or fiduciary relationships with sellers advertising their homes for sale by owner or buyers purchasing a for sale by owner property. It is important to understand that SimplyFSBO, Inc. functions solely as a marketing platform and coordination service and does not provide real estate brokerage services.

Bob Strupp is a licensed broker associate who operates SimplyFSBO, Inc. in Iowa and Illinois, and is affiliated with eXp Realty as a broker. He has a proven track record of success in the real estate industry and is capable of providing limited guidance to buyers and sellers who wish to sell their property without the assistance of a licensed agent. It is important to note that SimplyFSBO, Inc. is an independent entity and is not affiliated with eXp Realty. If you choose to buy or sell a property as a for-sale-by-owner (FSBO), Bob cannot legally represent you as a licensed real estate agent unless there is a written agency and listing agreement through eXp Realty. At that point, you will no longer be considered a FSBO seller.

As a seller utilizing SimplyFSBO, Inc.’s services, you will be required to pay a fee to post your home on their “For Sale by Owner” website. Additionally, SimplyFSBO, Inc. will provide marketing and coordination services, which may include assistance with photographs, 3D scans, floor plans, real estate signs, managing your Zillow and Trulia listings, and providing recommendations on marketing strategies and tips to attract potential buyers. SimplyFSBO, Inc. may also provide you with referrals for attorneys as needed.

Upon request, SimplyFSBO, Inc. will also manage your Zillow & Trulia posting using your existing account, but you understand that SimplyFSBO, Inc. is not affiliated with Zillow or Trulia and will only manage the posting by you providing us temporary access to your account.

Both buyers and sellers should refrain from disclosing any confidential information that may put them at a disadvantage during the process of buying, selling, and/or negotiating real estate.

When a buyer and seller are ready to enter into a purchase agreement, SimplyFSBO, Inc. will connect you to licensed professionals and/or attorneys to complete the transaction without commissions. However, SimplyFSBO, Inc. does not negotiate offers on behalf of either party. Our online “Make an Offer” functionality is only intended to help buyers and sellers negotiate the details of a purchase agreement before providing the desired terms to a real estate professional or attorney to prepare the official legal & binding contract. You remain solely responsible for all aspects of the sales transaction. This includes, but is not limited to, negotiating, drafting and executing contracts, and complying with all applicable laws and regulations.

As the seller, it is your responsibility to screen potential buyers before showing the property. SimplyFSBO, Inc. is not responsible for any incidents that may occur during the showing and does not engage in expressed agency or implied agency relationships with unrepresented buyers or sellers advertising on SimplyFSBO.com.

SimplyFSBO, Inc. is not responsible for any inaccurate information posted on its website or other platforms. It is your responsibility to update or notify SimplyFSBO, Inc. of any inaccurate information to ensure the accuracy of the information.

Our company operates on a policy of upfront payment, which is non-refundable, even if you decide not to post your listing. We invest a significant amount of time in preparing your listing before it is posted. We appreciate your understanding that refunds are not offered.
